Indefinite Leave to Remain (ILR) gives you the right to live, work and study in the UK without time restrictions. It is the final step before British citizenship and the long-term goal for work or business visa holders. Eligible applicants can apply after a qualifying period of lawful residence, meeting all Home Office requirements.

Eligible routes include

You may be eligible to apply for Indefinite Leave to Remain (ILR) if you have lived lawfully in the UK under an eligible visa category for the required period and meet all other Home Office criteria. Eligible visa routes include:

 

– Skilled Worker Visa – Eligible after 5 years of continuous residence. You must meet the salary requirement, remain sponsored by the same employer, and satisfy good character and suitability checks.


 

– Global Talent Visa – A fast‑track route to settlement. Eligible after 3 years if endorsed as an exceptional talent or under most science and research categories, or after 5 years if endorsed as exceptional promise.

 

– Innovator Founder Visa – Eligible after 3 years if your endorsing body confirms you have met the required business innovation and growth criteria.


 

– Senior or Specialist Worker (Global Business Mobility) – This route does not lead directly to ILR. However, you may switch into a settlement‑leading visa, such as the Skilled Worker route, and then complete the necessary qualifying period.

– Representative of an Overseas Business (Sole Representative) – Eligible after 5 years, provided the UK branch or subsidiary continues trading and you remain in your representative role.


 

Other eligible categories may include Minister of Religion, International Sportsperson, UK Ancestry, and certain long‑term business or work visas depending on residence history.

Qualifying criteria

Applicants must meet specific criteria set to qualify for their chosen visa route. Meeting eligibility early helps avoid delays and refusals. The general qualifying criteria are:

 

Complete the required residence period

You must have lived lawfully in the UK for the qualifying number of years under an eligible visa route (usually 5 years, or 3 years for certain fast‑track categories such as Global Talent or Innovator Founder).

 

Pass the Life in the UK Test

This test assesses your knowledge of British history, culture, and everyday life. It must be passed before submitting your ILR application unless you are exempt due to age or medical condition.

 

Maintain visa category criteria

You must continue to meet the requirements of your current visa throughout your qualifying period, such as employment, salary, or business activity conditions.

 

Meet continuous residence rules

You must not have spent more than 180 days outside the UK in any 12‑month period during your qualifying stay. Excess absences can break continuity and delay eligibility.

 

Meet the English language requirement

You must demonstrate English ability through an approved test or qualification, unless exempt based on nationality, age, or prior UK education.

 

Have no serious immigration or criminal breaches

Your immigration history must show compliance with visa conditions, and you must not have any unspent criminal convictions or breaches of UK immigration law.

Duration of stay

Once Indefinite Leave to Remain is granted, you can live, work, and study in the UK without any time limit. Your status does not expire, and you can travel to and from the UK as you wish, however ILR can be lost if you leave the UK for more than two consecutive years.  This would be treated as giving up your settled status and if that happens, you may need to apply for a Returning Resident Visa to regain your right to live in the UK permanently.

Work rights

Holders of Indefinite Leave to Remain have full rights to work and conduct business in the UK without restrictions. You can take up employment with any employer, become self‑employed, establish or manage a company, or engage in voluntary and freelance work. Unlike sponsored visas, Indefinite Leave to Remain does not tie you to a specific role or organisation, giving you complete flexibility to pursue new career opportunities or business ventures.

Can my dependants apply for ILR with me?
Yes. Your partner and children can apply if they meet the residence requirement, which is usually five years in the UK. Dependants must also show continuous residence and maintain valid leave during this period.

 

Does time spent on other visas count towards ILR?
Sometimes. Certain visa routes can be combined to reach the qualifying period — for example, time spent under the Skilled Worker and UK Ancestry routes. However, time on temporary visas such as Student or Visitor visas normally does not count.

 

Can I apply for ILR if I changed employers or visa routes?
